Please read these Terms and Conditions carefully before using any Games developed by Your Choice Game Studio. These Terms and Conditions form a legally binding agreement between You and the Company, governed by the Indian Contract Act, 1872, and the Information Technology Act, 2000, for electronic contracts. These Terms apply to all games developed by Your Choice Game Studio unless otherwise specified in supplemental terms for a specific game.
Words with initial capital letters have meanings defined under the following conditions. These definitions shall have the same meaning whether they appear in singular or plural form, as per the Indian Contract Act, 1872.
For the purposes of these Terms and Conditions:
Affiliate means an entity that controls, is controlled by, or is under common control with a party, where "control" means ownership of 50% or more of the shares, equity interest, or other securities entitled to vote for the election of directors or other managing authority.
Company (referred to as "the Company", "We", "Us", or "Our" in this Agreement) refers to Your Choice Game Studio, a company registered under the laws of India.
Country refers to: Maharashtra, India
Device means any device that can access the our Games, such as a cellphone, digital tablet, or other compatible mobile device.
Games (also referred to as "App") refers to all mobile games developed by Your Choice Game Studio, available for download on the Google Play Store, unless otherwise specified in supplemental terms for a specific game.
Game Content means all content within the Games, including but not limited to graphics, music, text, characters, levels, and other materials, protected under the Copyright Act, 1957, and Trade Marks Act, 1999.
In-App Purchases refers to purchases of virtual goods, services, or subscriptions made within the Games, as facilitated through the Google Play Store.
Platform refers to the Google Play Store, the distribution platform through which the Games is made available to users.
Terms and Conditions (also referred to as "Terms") mean these Terms and Conditions that form the entire agreement between You and the Company regarding the use of the Games, enforceable under Section 2(h) of the Indian Contract Act, 1872.
Third-party Service means any services or content (including data, information, products, or services) provided by a third party, such as Google Play Store or social media platforms, that may be integrated with or accessed through the Games.
User Account means an account created by You to access and use certain features of the Games, such as saving progress or participating in online features.
Virtual Currency means in-game currencies (e.g., coins, gems) purchased or earned within the Games, used for In-App Purchases or gameplay enhancements, which have no real-world monetary value.
You means the individual accessing or using the Games, or the company or other legal entity on behalf of which such individual is accessing or using the Games, provided You are competent to contract under Section 11 of the Indian Contract Act, 1872.
These Terms and Conditions govern the use of all Games developed by Your Choice Game Studio and constitute a legally binding contract between You and the Company under the Indian Contract Act, 1872. They set out the rights and obligations of all users regarding the use of the Games, formed through offer, acceptance, and lawful consideration as required by Section 10 of the Act. These Terms apply to all games unless supplemented by game-specific terms, which will be provided within the relevant Games or on Our website.
Your access to and use of the Games is conditioned on Your acceptance of and compliance with these Terms and Conditions, which may be accepted electronically (e.g., by clicking "I Agree") as valid under Section 10A of the Information Technology Act, 2000. These Terms apply to all players, users, and others who access or use any Games. The Games is developed and operated in compliance with Google Play Store’s Developer Program Policies, ensuring adherence to guidelines on user conduct, content, and monetization.
By accessing or using the Games, You agree to be bound by these Terms and Conditions. If You disagree with any part of these Terms, You may not download, install, or use the Games.
You represent that You are at least 13 years of age, as required to comply with Google Play Store policies and applicable laws, including Section 11 of the Indian Contract Act, 1872. Users under 13 years of age may only use the Games with verifiable parental consent, as facilitated through Google Play’s Family Link or other mechanisms, in compliance with applicable laws and Google Play Store policies.
Your access to and use of the Games is also conditioned on Your acceptance of and compliance with the Company's Privacy Policy, which complies with the Digital Personal Data Protection Act, 2023, and Google Play Store data protection requirements. The Privacy Policy details how We collect, use, and disclose personal information, such as User Account details and gameplay data, and informs You about Your privacy rights.
Note: This agreement is an electronic contract under Section 10A of the Information Technology Act, 2000, and is unlikely to require stamp duty under the Indian Stamp Act, 1899, for standard app usage. However, You are advised to verify compliance with applicable state laws if entering into additional agreements with the Company.
Certain Games may have additional terms or policies specific to their features, content, or monetization models, which will be provided within the Games or on Our website. Such supplemental terms are incorporated into these Terms and Conditions and will apply in addition to or in place of specific provisions herein, as indicated.
Each Games is assigned a content rating (e.g., E for Everyone, T for Teen) by the Google Play Store, indicating its suitability for specific audiences. Content ratings and regional availability may vary by Games. You are responsible for ensuring that Your use of the Games complies with the laws of Your jurisdiction and the applicable content rating.
The Games may offer In-App Purchases, including Virtual Currency, virtual goods, or subscriptions, facilitated through the Platform. All In-App Purchases are subject to the payment terms and refund policies of the Google Play Store. Refunds are processed in accordance with Google Play Store’s refund policy, typically within 48 hours of purchase for eligible transactions. No refunds will be provided for consumed Virtual Currency or virtual goods, except as required by the Consumer Protection Act, 2019, or other applicable laws.
You acknowledge that Virtual Currency and virtual goods purchased within the Games are non-transferable, non-refundable (except as required by law), and have no real-world monetary value. You are responsible for all charges incurred through Your User Account, including any applicable taxes, as per the Consumer Protection Act, 2019. The Company reserves the right to modify the pricing of In-App Purchases at any time, with notice provided through the Games or Google Play Store.
You agree to use the Games in compliance with these Terms and applicable laws. You shall not:
Violation of these rules may result in suspension or termination of Your User Account, as outlined in the Termination section below.
You are responsible for maintaining the confidentiality of Your User Account credentials, including usernames and passwords, used with the Games. You agree not to share, sell, or transfer Your User Account to any third party. The Company is not liable for any loss or damage arising from Your failure to secure Your User Account, including unauthorized access due to phishing or other user negligence, as per Section 73 of the Indian Contract Act, 1872.
If the Games allows You to create, upload, or share content (e.g., in-game profiles, avatars, or chat messages), You grant the Company a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display such content solely for the purpose of operating and improving the Games. You represent that Your content does not violate any laws, including the Information Technology Act, 2000, or infringe on the rights of others.
All Game Content, including games, designs, logos, text, music, and other materials, is the property of Your Choice Game Studio or its licensors and is protected by the Copyright Act, 1957, and the Trade Marks Act, 1999. You may not reproduce, distribute, modify, create derivative works, or use any Game Content (e.g., characters, artwork, or code) without prior written consent from the Company. Unauthorized modding, redistribution, or use of Game Content is strictly prohibited.
The Games may integrate with or link to Third-Party Services, such as Google Play Store or social media platforms, that are not owned or controlled by the Company.
The Company has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any Third-Party Services. You acknowledge and agree that the Company shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available through any such Third-Party Services, as per Section 73 of the Indian Contract Act, 1872.
We strongly advise You to read the terms and conditions and privacy policies of any Third-Party Services that You access through the Games.
We may terminate or suspend Your User Account and access to the Games immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if You breach these Terms and Conditions, engage in unauthorized activities (e.g., cheating or hacking), or violate applicable laws, as permitted under the Indian Contract Act, 1872.
Upon termination, Your right to use the Games and any associated Virtual Currency, virtual goods, or User Account will cease immediately. No refunds will be provided for In-App Purchases, except as required by the Consumer Protection Act, 2019, or Google Play Store policies.
Notwithstanding any damages that You might incur, the entire liability of the Company and any of its suppliers under any provision of these Terms and Your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by You through In-App Purchases in the Games or INR 1000 if You haven't purchased anything through the Games, as per Section 73 of the Indian Contract Act, 1872.
To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data, loss of Virtual Currency or virtual goods, or business interruption arising out of or in any way related to the use of or inability to use the Games, third-party software, and/or third-party hardware used with the Games, or otherwise in connection with any provision of these Terms), even if the Company or any supplier has been advised of the possibility of such damages.
Some jurisdictions, including under the Consumer Protection Act, 2019, do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages, so some of the above limitations may not apply. In these cases, each party's liability will be limited to the greatest extent permitted by law, provided such limitations are not deemed unconscionable under Section 23 of the Indian Contract Act, 1872.
The Games is provided to You "AS IS" and "AS AVAILABLE" with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, including the Consumer Protection Act, 2019, the Company, on its own behalf and on behalf of its Affiliates and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory, or otherwise, with respect to the Games, including all implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage, or trade practice. Without limitation to the foregoing, the Company provides no warranty or undertaking, and makes no representation of any kind that the Games will meet Your requirements, achieve any intended results, be compatible or work with any other software, applications, systems, or services, operate without interruption, meet any performance or reliability standards, or be error-free, or that any errors or defects can or will be corrected.
Without limiting the foregoing, neither the Company nor any of its providers makes any representation or warranty of any kind, express or implied: (i) as to the operation or availability of the Games, or the information, Game Content, Virtual Currency, or virtual goods included thereon; (ii) that the Games will be uninterrupted or error-free; (iii) as to the accuracy, reliability, or currency of any information or content provided through the Games; or (iv) that the Games, its servers, or content are free of viruses, scripts, trojan horses, worms, malware, timebombs, or other harmful components.
Some jurisdictions, including under the Consumer Protection Act, 2019, do not allow the exclusion of certain types of warranties or limitations on applicable statutory rights of a consumer, so some or all of the above exclusions and limitations may not apply to You. In such cases, the exclusions and limitations set forth in this section shall be applied to the greatest extent enforceable under applicable law.
The laws of India, specifically the Indian Contract Act, 1872, the Information Technology Act, 2000, and other applicable statutes, including the Consumer Protection Act, 2019, excluding their conflicts of law rules, shall govern these Terms and Your use of the Games. Your use of the Games may also be subject to other local, state, national, or international laws.
If You have any concern or dispute about the Games, You agree to first try to resolve the dispute informally by contacting the Company. If the dispute remains unresolved, it shall be subject to the jurisdiction of the courts in Mumbai, Maharashtra, India, as per Section 20 of the Code of Civil Procedure, 1908, unless otherwise agreed by the parties.
If You are a European Union consumer, You will benefit from any mandatory provisions of the law of the country in which You are resident, in addition to the protections under the Consumer Protection Act, 2019, where applicable.
You represent and warrant that (i) You are not located in a country that is subject to a United States government embargo, or that has been designated by the United States government as a "terrorist supporting" country, and (ii) You are not listed on any United States government list of prohibited or restricted parties, as required for compliance with Google Play Store policies.
If any provision of these Terms is held to be unenforceable or invalid under Indian law, including Section 23 of the Indian Contract Act, 1872, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not affect a party's ability to exercise such right or require such performance at any time thereafter, nor shall the waiver of a breach constitute a waiver of any subsequent breach, as per the principles of the Indian Contract Act, 1872.
These Terms and Conditions may have been translated if We have made them available to You through the Games. You agree that the original English text shall prevail in the case of a dispute, as recognized under Indian law.
We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material, We will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect, ensuring compliance with the Indian Contract Act, 1872, and Google Play Store policies. What constitutes a material change will be determined at Our sole discretion.
By continuing to access or use Our Games after those revisions become effective, You agree to be bound by the revised terms, forming a new agreement under the Indian Contract Act, 1872. If You do not agree to the new terms, in whole or in part, please stop using the Games.
