Terms & Conditions

Please read these Terms and Conditions carefully before using any Games developed by Your Choice Game Studio. These Terms and Conditions form a legally binding agreement between You and the Company, governed by the Indian Contract Act, 1872, and the Information Technology Act, 2000. These Terms apply to all games developed by Your Choice Game Studio unless otherwise specified in supplemental terms for a specific game.

Interpretation and Definitions

Interpretation

Words with initial capital letters have meanings defined under the following conditions. These definitions shall have the same meaning whether they appear in singular or plural form, as per the Indian Contract Act, 1872.

Definitions

For the purposes of these Terms and Conditions:

  • Affiliate means an entity that controls, is controlled by, or is under common control with a party, where "control" means ownership of 50% or more of the shares, equity interest, or other securities entitled to vote for election of directors or other managing authority.
  • Company (referred to as "the Company", "We", "Us", or "Our") refers to Your Choice Game Studio, a company registered under the laws of India.
  • Country refers to: Maharashtra, India
  • Device means any device that can access our Games, such as a cellphone, digital tablet, or other compatible mobile device.
  • Games (also referred to as "App") refers to all mobile games developed by Your Choice Game Studio, available for download on the Google Play Store, unless otherwise specified in supplemental terms for a specific game.
  • Game Content means all content within the Games, including but not limited to graphics, music, text, characters, levels, and other materials, protected under the Copyright Act, 1957, and Trade Marks Act, 1999.
  • In-App Purchases refers to purchases of virtual goods, services, or subscriptions made within the Games, as facilitated through the Google Play Store.
  • Platform refers to the Google Play Store, the distribution platform through which the Games is made available to users.
  • Terms and Conditions (also referred to as "Terms") mean these Terms and Conditions that form the entire agreement between You and the Company regarding the use of the Games, enforceable under Section 2(h) of the Indian Contract Act, 1872.
  • Third-party Service means any services or content provided by a third party, such as Google Play Store or social media platforms, that may be integrated with or accessed through the Games.
  • User Account means an account created by You to access and use certain features of the Games, such as saving progress or participating in online features.
  • Virtual Currency means in-game currencies (e.g., coins, gems) purchased or earned within the Games, used for In-App Purchases or gameplay enhancements, which have no real-world monetary value.
  • You means the individual accessing or using the Games, or the company or other legal entity on behalf of which such individual is accessing or using the Games, provided You are competent to contract under Section 11 of the Indian Contract Act, 1872.

Acknowledgment

These Terms and Conditions govern the use of all Games developed by Your Choice Game Studio and constitute a legally binding contract between You and the Company under the Indian Contract Act, 1872. They set out the rights and obligations of all users regarding the use of the Games, formed through offer, acceptance, and lawful consideration as required by Section 10 of the Act.

Your access to and use of the Games is conditioned on Your acceptance of and compliance with these Terms and Conditions, which may be accepted electronically (e.g., by clicking "I Agree") as valid under Section 10A of the Information Technology Act, 2000.

By accessing or using the Games, You agree to be bound by these Terms and Conditions. If You disagree with any part of these Terms, You may not download, install, or use the Games.

You represent that You are at least 13 years of age, as required to comply with Google Play Store policies and applicable laws, including Section 11 of the Indian Contract Act, 1872. Users under 13 years of age may only use the Games with verifiable parental consent.

Your access to and use of the Games is also conditioned on Your acceptance of and compliance with the Company's Privacy Policy, which complies with the Digital Personal Data Protection Act, 2023, and Google Play Store data protection requirements.

Note: This agreement is an electronic contract under Section 10A of the Information Technology Act, 2000, and is unlikely to require stamp duty under the Indian Stamp Act, 1899, for standard app usage.

Game-Specific Terms

Certain Games may have additional terms or policies specific to their features, content, or monetization models, which will be provided within the Games or on Our website. Such supplemental terms are incorporated into these Terms and Conditions.

Content Rating and Regional Availability

Each Game is assigned a content rating (e.g., E for Everyone, T for Teen) by the Google Play Store, indicating its suitability for specific audiences. Content ratings and regional availability may vary by Game. You are responsible for ensuring that Your use of the Games complies with the laws of Your jurisdiction and the applicable content rating.

In-App Purchases and Virtual Goods

The Games may offer In-App Purchases, including Virtual Currency, virtual goods, or subscriptions, facilitated through the Platform. All In-App Purchases are subject to the payment terms and refund policies of the Google Play Store. Refunds are processed in accordance with Google Play Store's refund policy, typically within 48 hours of purchase for eligible transactions. No refunds will be provided for consumed Virtual Currency or virtual goods, except as required by the Consumer Protection Act, 2019.

You acknowledge that Virtual Currency and virtual goods purchased within the Games are non-transferable, non-refundable (except as required by law), and have no real-world monetary value. The Company reserves the right to modify the pricing of In-App Purchases at any time, with notice provided through the Games or Google Play Store.

User Conduct and Game Rules

You agree to use the Games in compliance with these Terms and applicable laws. You shall not:

  • Use cheats, hacks, or unauthorized software to exploit or manipulate the Games.
  • Engage in abusive, offensive, or harassing behavior toward other users, including through in-game chat or user-generated content.
  • Attempt to reverse-engineer, decompile, or otherwise access the source code of the Games, as prohibited under Section 66 of the Information Technology Act, 2000.
  • Use the Games for any unlawful or unauthorized purpose.

Violation of these rules may result in suspension or termination of Your User Account, as outlined in the Termination section below.

Account Security

You are responsible for maintaining the confidentiality of Your User Account credentials, including usernames and passwords. You agree not to share, sell, or transfer Your User Account to any third party. The Company is not liable for any loss or damage arising from Your failure to secure Your User Account, including unauthorized access due to phishing or other user negligence, as per Section 73 of the Indian Contract Act, 1872.

User-Generated Content

If the Games allows You to create, upload, or share content (e.g., in-game profiles, avatars, or chat messages), You grant the Company a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display such content solely for the purpose of operating and improving the Games. You represent that Your content does not violate any laws, including the Information Technology Act, 2000, or infringe on the rights of others.

Intellectual Property

All Game Content, including games, designs, logos, text, music, and other materials, is the property of Your Choice Game Studio or its licensors and is protected by the Copyright Act, 1957, and the Trade Marks Act, 1999. You may not reproduce, distribute, modify, create derivative works, or use any Game Content without prior written consent from the Company. Unauthorized modding, redistribution, or use of Game Content is strictly prohibited.

Links to Third-Party Services

The Games may integrate with or link to Third-Party Services, such as Google Play Store or social media platforms, that are not owned or controlled by the Company. The Company has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any Third-Party Services.

We strongly advise You to read the terms and conditions and privacy policies of any Third-Party Services that You access through the Games.

Termination

We may terminate or suspend Your User Account and access to the Games immediately, without prior notice or liability, for any reason whatsoever, including if You breach these Terms, engage in unauthorized activities (e.g., cheating or hacking), or violate applicable laws, as permitted under the Indian Contract Act, 1872.

Upon termination, Your right to use the Games and any associated Virtual Currency, virtual goods, or User Account will cease immediately. No refunds will be provided for In-App Purchases, except as required by the Consumer Protection Act, 2019, or Google Play Store policies.

Limitation of Liability

The entire liability of the Company under any provision of these Terms shall be limited to the amount actually paid by You through In-App Purchases in the Games, or INR 1000 if You haven't purchased anything through the Games, as per Section 73 of the Indian Contract Act, 1872.

To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever, including damages for loss of profits, loss of data, loss of Virtual Currency or virtual goods, or business interruption arising out of or in any way related to the use of or inability to use the Games.

"AS IS" and "AS AVAILABLE" Disclaimer

The Games is provided to You "AS IS" and "AS AVAILABLE" with all faults and defects without warranty of any kind. The Company expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including all implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Neither the Company nor any of its providers makes any representation or warranty that the Games will be uninterrupted or error-free, or that the Games, its servers, or content are free of viruses, malware, or other harmful components.

Governing Law

The laws of India, specifically the Indian Contract Act, 1872, the Information Technology Act, 2000, and other applicable statutes including the Consumer Protection Act, 2019, shall govern these Terms and Your use of the Games.

Disputes Resolution

If You have any concern or dispute about the Games, You agree to first try to resolve the dispute informally by contacting the Company. If the dispute remains unresolved, it shall be subject to the jurisdiction of the courts in Mumbai, Maharashtra, India, as per Section 20 of the Code of Civil Procedure, 1908.

For European Union (EU) Users

If You are a European Union consumer, You will benefit from any mandatory provisions of the law of the country in which You are resident, in addition to the protections under the Consumer Protection Act, 2019, where applicable.

United States Legal Compliance

You represent and warrant that (i) You are not located in a country subject to a United States government embargo, and (ii) You are not listed on any United States government list of prohibited or restricted parties, as required for compliance with Google Play Store policies.

Severability and Waiver

Severability

If any provision of these Terms is held to be unenforceable or invalid under Indian law, including Section 23 of the Indian Contract Act, 1872, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible, and the remaining provisions will continue in full force and effect.

Waiver

The failure to exercise a right or to require performance of an obligation under these Terms shall not affect a party's ability to exercise such right or require such performance at any time thereafter, nor shall the waiver of a breach constitute a waiver of any subsequent breach, as per the principles of the Indian Contract Act, 1872.

Translation Interpretation

These Terms and Conditions may have been translated if We have made them available to You through the Games. You agree that the original English text shall prevail in the case of a dispute, as recognized under Indian law.

Changes to These Terms and Conditions

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material, We will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use Our Games after those revisions become effective, You agree to be bound by the revised terms. If You do not agree to the new terms, please stop using the Games.
